2021
- Resolved an owner concern over limited access to amenity spaces due to COVID-19 health protocols. IDR resulted in refund of monthly access fees to all owners.
- Resolved an owner concern over HOA’s failure to seek a vote of the membership to increase assessments greater than 20%. IDR resulted in budget reduction to 20% increase and credit to all owners for overpayment. (The HOA subsequently took a vote of the members who declined to approve an additional increase.)
- Resolved an owner concern over HOA’s failure to enforce governing documents. IDR resulted in a violation notice to a neighbor and nuisance abatement within 30-days.
2022
- Resolved an owner concern over HOA’s failure to perform maintenance in accordance with a special assessment disclosure notice. IDR resulted in the work being scheduled two weeks later.
- Resolved a resident’s concern over HOA’s harassment based on familial status and sexual orientation. CRD (DFEH) case resulted in an HOA Director resignation, a $4,000 settlement paid by the resigned Director to the resident, mandatory fair housing training by the managers and Board of Directors, and an educational public notice posted in each common laundry room regarding fair housing rights.
2023
- Resolved an owner concern over damage to their home caused by an HOA tree that was negligently maintained. IDR resulted in HOA’s agreement to pay 90% of the amount demanded by the owner and an agreement to remove the tree and never plant another near the home.
- Resolved an owner concern over a neighbor’s nuisance that had gone unabated despite HOA’s written acknowledgment of the nuisance. IDR resulted in the HOA abating the nuisance and the offending neighbor selling their property and moving out of state.
- Resolved an owner concern over significant past due HOA accounts of other members. IDR resulted in HOA retaining a collections agent who collected 60% of the money due within 45-days and recorded liens for the remainder within 120-days.
2024
- Resolved an owner concern over being double billed for regular assessments after HOA didn’t process checks timely. IDR resulted in a refund of overpayment and late fees.
- Resolved an owner concern over discriminatory conduct by HOA managers and Board of Directors in relation to disability architectural modification needs. CRD (DFEH) case resulted in a $10,000 settlement to the owner and mandatory fair housing training by the managers and Board of Directors.
- Resolved an owner concern over illegal service animal restrictions and discriminatory statements made by HOA Directors. CRD (DFEH) case resulted in HOA making two charitable donations, mandatory fair housing training by the managers and Board of Directors, and rewriting of the service animal policy.
- Resolved an owner concern over HOA approval of architectural changes to the neighbor’s house that violated the documented community standards. IDR resulted in the rescission of the approval and a reversal of the changes. (The neighbor subsequently sued the HOA in small-claims court for the costs of the reversal and lost at trial on the basis that the request should not have been made in the first place as it violated the documented community standards and was not based on reasonable accommodation.)
- Resolved an owner concern over HOA’s failure to enforce governing documents and failure to provide pre-notice of pesticide application near the condo. IDR resulted in a written resolution with HOA agreeing to terms proposed by the owner.
